Data Protection Clarifications and Consent to the processing of Personal Data

Foreword

Below, we, MyHammer AG, inform you how we collect and use your personal data in the context of the use of our offers. Here you will find more detailed information about us: (MyHammer-Homepage > General > Imprint).

When you access and use the MyHammer website, depending on how you utilise it, various information is transmitted to us via your PC or other terminal device, such as a smartphone, with which you use MyHammer (hereinafter: your "system"). The majority of the information transmitted in the context of use is not personal. In the following data protection notice, we explain what information and personal data is concerned and how we use it.

But the most important thing at this point: A sensitive and responsible handling of your personal data is an elementary component of a serious and customer-oriented company activity for us. The principle of data minimization is of great importance even at the data collection stage. We only collect and process your personal data if you have given us your consent or if the law expressly permits or prescribes us to do.


1. Access data and hosting

You can visit our website without providing any personal information. Each time a website is accessed, the web server automatically merely saves a so-called server log file which, for example, contains the name of the requested file, your IP address, date and time of access, the amount of data transmitted and the requesting provider (access data) and documents the access.

These access data are evaluated exclusively for the purpose of ensuring trouble-free operation of the site and improving our services. Pursuant to Art. 6 para. 1 sentence 1 f GDPR, this serves to safeguard our legitimate interests in a correct presentation of our offer, which predominate within the scope of a balancing of interests. All access data will be deleted no later than seven days after the end of your visit to the site.

Third-party hosting services

As part of a data processing, a third party supplier provides us with the hosting services for the website. This is done following our legitimate interests in a correct presentation of our offers, which is a predominate interest. All data collected in the context of the use of this website or in forms provided for this purpose, as described below, are processed on its servers. Processing on other servers only takes place in the framework described here.

This service provider is located within a country of the European Union or the European Economic Area. Data processing takes place within the European Union.

2. Data collection and use for contract processing and registration

The majority of our offers can only be used by you if you register with us. You can then, for example, post bid invitations, participate in bid invitations, view them or submit ratings. We ask for data which are necessary or recommendable for the use (e.g. execution of the tenders or the usage relationship. This includes in particular your name, address and other contact information, such as your mobile phone number. In connection with the collection of data, we point out that information is mandatory. We use the data provided by you in accordance with Art. 6 Para. 1 S. 1 lit. b GDPR for contract processing and processing your enquiries. Furthermore it can come to a use of the data due to legal obligations.

With craftsmen and service providers (contractors) MyHammer also stores a provider profile and payment information for the payment of the usage fees. Finally, information about the type and content of the invitations to tender in which you have participated as a provider is stored. Furthermore, in order to provide evidence of individual details stored in the member profile, we request copies of certificates from contractors, e.g. with regard to trade law or other entries, approvals or qualifications, a confirmation of the business registration ("trade licence") or the notification of a freelance activity, the trade card, the master certificate or comparable certificates. These documents are stored in electronic form for the duration of membership or for the duration of statutory retention obligations.

After complete processing of the contract or deletion of your member account, your data will be restricted for further processing and deleted after expiry of the storage periods under tax and commercial law, unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration. The deletion of your member account is possible at any time and can take place either via a message to the contact option described below or via a function provided for this purpose.

3. Data transfer

In order to fulfil the contract in accordance with Art. 6 para. 1 sentence 1 lit. b GDPR, we provide data - depending on the payment method chosen by you - for processing payments to the credit institution or payment service provider commissioned with payment. In some cases, the selected payment service providers also collect such data themselves if you create an account there. In this case, you must log in to the payment service provider with your access data during the ordering process. The data protection declaration of the respective payment service provider applies in this respect.

As far as third parties receive your data, this is done for the following purposes:

  • To transmit your name and, if applicable, your address data in connection with the initiation and processing of the contractual relationship, for example to establish contact between the client and the contractor (Art. 6 Para. 1 S. 1 lit. b GDPR)
  • Information to certain authorities within the scope of their statutory duties (Art. 6 para. 1 sentence 1 lit. c GDPR).

We also reserve the right to obtain information about the user from third parties for the verification of entered address data or to check the creditworthiness of our users. For this purpose, the information about the name or company, the address and, if applicable, the date of birth, collected during registration, is transmitted to a credit agency or another information service, which uses this data to check the validity of the address or the creditworthiness of the respective user. The credit agency, for its part, is obliged to protect data privacy. The legal basis for this is Art. 6 para. 1 sentence 1 lit. f GDPR.

In the event of non-contractual processing (e.g. termination due to default of payment, legally established claim), we can also transfer personal data to a credit agency or a collection service provider if the legal requirements are met. Art. 6 para. 1 sentence 1 lit. f GDPR is also the legal basis for this.

4. E-mail newsletter and postal advertising

E-mail advertising with registration for the newsletter

If you register for one of our newsletters, we use the data required for this or separately communicated by you in order to regularly send you our e-mail newsletter on the basis of your consent pursuant to Art. 6 para. 1 sentence 1 lit. a GDPR.

You can unsubscribe from the newsletter at any time and either by sending a message to the contact option described below or via a link provided for this purpose in the newsletter. After deregistration, we delete your e-mail address unless you have expressly consented to further use of your data or we reserve the right to use data beyond this, which is permitted by law and about which we inform you in this declaration.

E-mail advertising in connection with our services, your right of objection

If we receive your e-mail address in connection with our service and you have not objected to this, we reserve the right to inform you regularly by e-mail about MyHammer innovations and topics relating to the trade on the basis of Section 7 para. 3 UWG. You can revoke this at any time free of charge by using the unsubscribe link in the respective advertising e-mail.

Service provider for sending e-mails

Our newsletter is sent within the framework of a processing on our behalf by a service provider to whom we pass on your e-mail address for this purpose.

This service provider is based in the USA and is certified under the EU-US Privacy Shield. A current certificate can be viewed here. As a result of this agreement between the US and the European Commission, the latter has established an adequate level of data protection for companies certified under the Privacy Shield. We have also concluded an agreement with the service provider to protect your personal data in accordance with legal requirements.

Postal advertising and your right of objection

Furthermore, we reserve the right to use your first and last name as well as your postal address for our own advertising purposes, e.g. to send interesting offers and information about our products by post. This serves to safeguard our legitimate interests in an advertising approach to our customers in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, which predominate in the context of a weighing of interests.

The advertising mailings are processed on our behalf by a service provider to whom we pass on your data. You can object to the storage and use of your data for these purposes at any time by sending a message to the contact option described below.

5. Application data

When you apply to work with us, we collect various types of information, including contact information and a description of your education, work experience and skills. In addition, you have the option of providing us with electronically stored documents such as certificates or cover letters.

We do not require any information from you that is not usable under the General Equal Treatment Act (race, ethnic origin, gender, religion or belief, disability, age or sexual identity). We also do not ask you to provide information on illness, pregnancy, ethnic origin, political opinions, philosophical or religious beliefs, membership of a trade union, physical or mental health or sex life. The same applies to content that is likely to infringe the rights of third parties (e.g. copyrights, press law or general rights of third parties).

If we are unable to offer you employment, we will keep the information you provide for up to six months for the purpose of answering questions relating to your application and refusal.

However, if your application documents are of fundamental interest and no suitable employment is currently available, we ask you for a separate agreement to store and store your data accordingly. This way we can contact you for future vacancies.

Your data will be processed to establish and, if necessary, carry out the employment relationship in accordance with Art. 6 para. 1 sentence 1 letter b GDPR or Section 26 para. 1 BDSG.

6 Cookies and web analysis

To make visiting our website attractive and to enable the use of certain functions, to display suitable products or for market research purposes, we use so-called cookies on various pages. This serves to safeguard our legitimate interests in an optimised presentation of our offer in accordance with Art. 6 para. 1 sentence 1 lit. f GDPR, which predominate in the context of a balancing of interests. Analysis about Spoteffects / Piwik

Furthermore, through our service provider spoteffects, webeffects GmbH, Knorrstr. 69, 80807 Munich ("Spoteffects"), we measure the interaction with our website in correlation to broadcast TV spots. A corresponding contract for order data processing was concluded with Spoteffects. Spoteffects uses euaf results, which we generate using the analysis tool "Piwik". Piwik is an open source web analysis tool (http://de.piwik.org). When Piwik is used, data on user behavior is recorded and pseudonymous user profiles are created from it. Among other things, cookies (as described under I.4) are used for this purpose. We do not use the data from Piwik to personally identify you and do not merge the profiles with your person or your account. Sociomantic

We use the services of Sociomantic Labs GmbH (Paul-Lincke-Ufer 39/40, 10999 Berlin). Sociomantic Labs uses cookies to collect and process information about which websites were visited with your browser, which advertising spaces were clicked on, which products were viewed in online shops and which products were placed or purchased in the shopping basket. Sociomantic Labs also collects information about the attractiveness of online advertising, such as the number of clicks and the resulting online sales generated by an ad. This allows us to make the online advertising you see more relevant to you. We work together with Aumago GmbH ("Aumago"), Berlin, a target group marketer. Aumago uses so-called cookies, a text file that is stored in the browser of the computer and collects/contains anonymous usage data for the purpose of usage-based online advertising (Online Behavorial Targeting "OBA"), such as the type of website visited, categories visited and/or product pages and/or via which browser and terminal device this has been done. No personal information is recorded. The usage data cannot therefore be associated with the real identity of the user. The cookies are either Aumago cookies or cookies from service providers that Aumago uses. 7. advertising via marketing networks

Google AdSense

Our site uses Google AdSense to market space for third-party ads and advertising networks. These ads are displayed in various places on this website. As part of the integration of Google AdSense, the so-called DoubleClick cookie is set by Google for all page visitors.

We use Google Adwords to advertise this website in Google search results and on third-party websites. On our web pages anonymous information about the surfing behaviour of the web page visitors is collected and stored by a technology of Criteo GmbH for marketing purposes. Criteo GmbH uses an algorithm to analyze the anonymously recorded surfing behavior and can then display targeted product recommendations as personalized advertising banners on other websites (so-called publishers). 8 Social Media PlugIns

Use of social plugins from Facebook, Google, XING, LinkedIN, YouTube

On our website so-called social plugins ("plugins") are used by social networks. When you access a page of our website that contains such a plugin, your browser establishes a direct connection to the servers of Facebook, Google, Twitter or Instagram. The content of the plugin is transferred directly from the respective provider to your browser and integrated into the page. For videos from Youtube, which are integrated on our site, the extended data protection setting is activated. This means that no information from website visitors is collected and stored on YouTube unless they play the video. 9. Sending evaluation reminders by e-mail, eKomi

We use your e-mail address as a reminder to evaluate your order via the evaluation system we use. This use is made on the basis of the legitimate interest within the meaning of Art. 6 Para. 1 S. 1 lit. f GDPR, since the evaluation of users is necessary for the functionality of the MyHammer platform.

Our website loads a JavaScript code of eKomi Ltd, Markgrafenstr. 11 in 10969 Berlin, Germany. eKomi allows us to include customer reviews on our website. If you have activated JavaScript in your internet browser and do not have a JavaScript blocker running, personal data may be transmitted to eKomi. We cannot say what data eKomi receives and to what extent this data is used by eKomi. Further information is available directly from eKomi at http://www.ekomi.co.uk/uk/privacy/.

10 Use of location data

Your location data is only retrieved when required (during a search query) and temporarily stored on your end device. Via an interface (API) your location determined by the (mobile) device is transferred to the provided map (e.g. Google Maps, Apple Maps). However, our app does not actively transmit the location. If you do not want to release location data, you can switch this off in your mobile device. Alternatively, you can use the search function of your map app or browser.

11. Contact and your rights

As the data subject, you have the following rights:

  • according to Art. 15 GDPR the right to request information about your personal data processed by us to the extent described therein;
  • in accordance with Art. 16 GDPR the right to demand immediately the correction of incorrect or complete personal data stored by us;
  • pursuant to Art. 17 GDPR the right to request the deletion of your personal data stored with us, unless further processing is necessary
    • to exercise freedom of expression and information;
    • to fulfil a legal obligation;
    • for reasons of public interest, or
    • is necessary to assert, exercise or defend legal claims;
  • pursuant to Art. 18 GDPR, the right to request the restriction of the processing of your personal data, insofar as
    • the correctness of the data is denied by you;
    • the processing is unlawful, but you refuse to delete it;
    • we no longer need the data, but you do need it to assert, exercise or defend legal claims, or
  • pursuant to Art. 20 GDPR, to receive your personal data that you have provided to us in a structured, current and machine-readable format or to request its transfer to another person responsible;
  • the right to complain to a supervisory authority pursuant to Art. 77 GDPR. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at our company headquarters.

Right of objection

Insofar as we process personal data as described above in order to protect our legitimate interests, which predominate within the scope of a balance of interests, you can object to this processing with effect for the future.
